1. Acceptance of Terms

Welcome to TableMind. These Terms of Service ("Terms") govern your use of the TableMind mobile application, website, and related services (collectively, the "Service") operated by TableMind LLC ("TableMind," "we," "us," or "our"), a Massachusetts limited liability company.

By creating an account, downloading the app, or using the Service in any way, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use TableMind.

2. The Service

TableMind is a personal productivity tool designed for restaurant servers, bartenders, hosts, and hospitality workers to:

• Track shifts, tips, sales, hours, and related earnings data
• Maintain a personal guest book of regular customers and their preferences
• View insights, trends, and reports based on the data you enter
• Set goals and receive reminders

TableMind is not a financial, tax, legal, or accounting service. Any information, calculations, or projections provided by the Service are for your personal reference only and should not be relied upon as professional advice.

3. Your Account

Account creation

To use most features, you must create an account using a valid email address or a supported sign-in provider. You agree to provide accurate information and keep it up to date.

Account security

You are responsible for keeping your password and account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at infotablemind@gmail.com if you believe your account has been compromised.

One account per person

TableMind accounts are for individual use. You may not share your account with others or use another person's account without permission.

4. Subscriptions and Billing

Free and Pro tiers

TableMind offers a free tier with limited functionality and a paid Pro tier with expanded features. The specific features included in each tier are described on our website and within the app, and may change over time.

Pricing

TableMind Pro is billed at $7.99 USD per month, or as otherwise displayed at the time of purchase. Prices are subject to change. We will notify you of any price changes in advance, and continued use after the effective date constitutes your acceptance of the new price.

Payment processing

All subscription payments are processed through the Apple App Store. Your payment is charged to your Apple ID account upon confirmation of purchase. You authorize Apple to charge your payment method on a recurring basis until you cancel.

Auto-renewal

Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID settings.

5. Free Trial

We may offer a free trial of TableMind Pro to new subscribers. Unless you cancel before the trial period ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

Free trials are available only to users who have not previously subscribed to TableMind Pro. We reserve the right to determine eligibility and to modify or discontinue trial offers at any time.

6. Cancellation and Refunds

Cancel anytime

You can cancel your subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of your current billing period — you will continue to have Pro access until then.

Refunds

All refund requests are handled by Apple in accordance with their policies. TableMind does not directly issue refunds for App Store purchases. You can request a refund through reportaproblem.apple.com.

Access after cancellation

If your subscription lapses or you cancel, your account will revert to read-only access. You can still view and export your data, but you will not be able to add or edit entries until you resubscribe. Your data is preserved and will be available if you resubscribe in the future.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its servers
• Use automated systems (bots, scrapers) to access or collect data from the Service
• Upload malicious code, viruses, or any content designed to harm the Service or other users
• Impersonate another person or misrepresent your identity
• Use the Service to store, share, or process data about others without their consent in violation of privacy laws
• Resell, sublicense, or commercially exploit the Service without our written permission

8. Your Content

You own your data

You retain all rights to the content you input into TableMind, including shift data, guest information, notes, and any other data you enter ("Your Content"). We do not claim ownership of Your Content.

License to operate the Service

You grant us a limited, non-exclusive, worldwide license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license ends when you delete Your Content or close your account, except as needed for legal compliance or legitimate backup retention.

Responsibility for Your Content

You are solely responsible for Your Content and for ensuring you have the right to store the information you enter. In particular, you are responsible for complying with applicable privacy laws when storing information about other people (such as your guests).

Data export

You can export Your Content at any time through the in-app export feature, on both Free and Pro tiers.

9. Intellectual Property

All rights, title, and interest in and to the Service — including the app, website, logos, trademarks, design, code, and features — are owned by TableMind LLC and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written permission.

10. Termination

Termination by you

You may stop using the Service and close your account at any time through the app settings or by contacting us.

Termination by us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide notice when reasonable.

Effect of termination

Upon termination, your right to use the Service ends immediately. We will retain Your Content for a reasonable period to allow for export or account recovery, after which it may be permanently deleted.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. We do not warrant that the information in the Service (including calculations, projections, and insights) is accurate, complete, or reliable for any particular purpose.

You use the Service at your own risk. You are responsible for backing up Your Content and for verifying any information before relying on it for tax, legal, or financial decisions.

12. Tax Calculations and Estimates

TableMind provides tools that may calculate, estimate, or summarize tax-related information based on data you enter. This includes (without limitation) tax reserve estimates, quarterly tax projections, year-end income summaries, and similar features.

Not a tax preparer or advisor

TableMind LLC is not a Certified Public Accountant, Enrolled Agent, tax preparer, tax attorney, or financial advisor. We do not provide tax advice. The tools and information in the Service are for your personal planning and record-keeping only.

Estimates only

Tax-related calculations are estimates based on the data you enter and general assumptions (such as tax rates you configure). They may not reflect your actual tax liability. Tax laws are complex, vary by jurisdiction, and change frequently. We make reasonable efforts to keep calculations current but do not guarantee they reflect the most recent law applicable to your situation.

Not an official tax filing

Documents and reports generated by the Service — including summaries, projections, and any tax-related PDFs — are personal records only. They are not official tax filings, are not submitted to the IRS or any state agency, and should not be treated as a substitute for official tax forms or returns.

Your responsibility

You are solely responsible for:

• The accuracy of data you enter into the Service
• Verifying any calculation or estimate before relying on it
• Filing your own tax returns and meeting tax obligations
• Consulting a qualified tax professional for advice specific to your situation

By using any tax-related feature of the Service, you acknowledge and accept these limitations.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABLEMIND LLC, ITS OWNERS, AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) $100 USD.

Some jurisdictions do not allow the limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless TableMind LLC, its owners, and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any applicable law
• Your violation of any third party's rights, including privacy rights
• Your Content

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app, by email, or by posting the updated Terms on our website with a new "Last updated" date.

Your continued use of the Service after the effective date of any changes means you accept the updated Terms. If you do not agree, you must stop using the Service.

16. Governing Law and Disputes

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Dispute resolution

Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation. If we cannot resolve the dispute informally, it will be resolved in the state or federal courts located in Middlesex County, Massachusetts, and you consent to the personal jurisdiction of those courts.

No class actions

You agree that any dispute will be resolved on an individual basis, and you waive any right to participate in a class action lawsuit or class-wide arbitration.
